Under the Local Government (Miscellaneous Provisions) Act 1960 Council is not able to issue retrospective building licenses for unauthorised structures.

However, providing the structures meet all legislative requirements and an engineering report is obtained certifying that the structure has been constructed in accordance with earthquake requirements for region, (AS1170.4) the structures may be formalised via a process to the Minister for Local Government.
